Owl City, Carly Rae Jepsen's 'Good Time' at center of copyright infringement case

Sacramento residents might be getting tired of "Good Time," Carly Rae Jepsen's duet with Owl City. It's been so popular that it seems to be everywhere -- on the radio, in previews for "Hotel Transylvania," on "Parks and Recreation," etc.

But one person isn't having a 'good time' with the song. That person would be Allyson Nichole Burnett, the Alabama-based singer-songwriter who recently sued Jepsen, Owl City and two music publishers over "Good Time," alleging that it infringes on the copyright of her 2010 single, "Ah, It's a Love Song."

(A copyright is a legal privilege granting the holder the sole power to distribute, reproduce or perform a work, such as a song.)

Burnett's lawsuit gets very specific, alleging similarities between the two songs' timbre, "melodic contour," and pitch sequence. However, it also makes the very broad allegation that "Good Time" copies "Ah, It's a Love Song" by mimicking it as "a catchy pop vibe that both draws people in and sticks in people's heads."

Burnett is claiming damage to her reputation, reduced earning power and emotional and psychological damage, because fans believe she copied "Good Time" and not the other way around.

Jepsen and Owl City have not commented on the suit.

Lawsuits of this sort are among the types we work on in our Sacramento office. If you want to know more about copyright law, you could check out our Copyright page. We've taken care to build our page with relevant information, so we hope it can become a resource to you.
