Was Khloe Kardashian's t-shirt a case of copyright infringement?

As Sacramento readers know, the Kardashian sisters make a pretty good living as it is, but if they ever wanted to expand their reality TV empire, they might consider a series detailing the intellectual property troubles they've faced with their various money-making ventures.

Not long after they agreed to rename their line of beauty products because they had been accused of infringing on another company's trademark, a new potential intellectual property litigation issue has arisen.


This time, it concerns Khloe Kardashian and her NBA star husband Lamar Odom's "Rich Soil" clothing line.

Rich Soil sells a $35 t-shirt that has a logo depicting the Statue of Liberty and the words "Rich Soil." The problem is, it seems very similar to a logo that the New York Department of Agriculture uses to promote grown-in-New-York products.

Rich Soil was recently sent a cease-and-desist letter and has evidently pulled the T-shirt from its lineup of products.

Now, some gossip websites have construed that as an admission of guilt, but that is not the right way to look at it. Most likely, Rich Soil just decided it was not worth the effort to defend a single one of its products.

Whether yanking the t-shirt off Rich Soil's website will be enough to satisfy the New York Department of Agriculture remains to be seen. In its letter, it said it wants to know how much money Rich Soil has made from the t-shirt, and then wants a cut of that.
