Did you know that trademarks can't include certain words?

Customers often remember unique trademarks. You may even find that companies will come to you and ask to license your mark if it's well-recognized or admired by others. Shear recognition and licensing deals can make your trademark quite valuable. Knowing what types of words you can use when registering your trademark is the first step in crafting a mark that others will remember.

What you shouldn't do

There's a prohibition on the use of last names when registering a trademark. Using descriptive words, or ones that describe the item that you're selling, such as "athletic shoes" or "iced coffee" is a problem as well.

While there's no prohibition against the use of generic words like "American, platinum or organic" in your trademark, these terms don't help you create a memorable mark. You should avoid using acronyms and numbers in your trademark for much the same reason. Avoiding commonly misspelled words or ones that are often confused for similar ones will also save you from having your registration rejected.

What you should do

One step that you should take when designing your mark is to have it depict the experience that customers should expect when they do business with you.

It would be best if you also aimed to invent a name for your business and use it on your trademark instead of using a familiar, and thus, unmemorable one. Marks that have resonated quite well with consumers in the past have been ones associated with plants or animals or ones that people don't typically associate with the product at hand. One example of the latter is Apple and its association with computers.

Coming up with a name for your company can be fun. It can be unpleasant for you to find out that the trademark you selected for your California business isn't available for registration. An attorney can help you determine if you can move forward in registering the moniker that you selected and advise you of the next steps that you should take to do just that here in Roseville.
