What types of patents are available to individuals and companies?

3D printing creates issues with patent infringement

The rise of 3D printing technology has opened up a world of possibilities for small businesses and technology entrepreneurs. Use of this printing method can reduce overall costs for both businesses and consumers. It makes products readily available to consumers through computer-aided design (CAD) files - provided they have the technology necessary to "print" it into physical form.

Child patents may run up against terminal disclaimers

California companies who want to extend the terms of their patents may find that court precedents prevent them from using child patents to do so. In one December 2015 judgment, the U.S. District Court for the Western District of Michigan decided that an automotive holdings company was justified in seeking a judgment of invalidity against an electronics company that had filed a child patent in 1999.

Gillette files lawsuit over patent violations

California residents who rely on the Dollar Shave Club may be interested to learn that Gillette filed a lawsuit against Dollar Shave Club for patent violations in December. According to the lawsuit, the razors provided by the Dollar Shave Club use coating methods that were patented by Gillette in 2004.

Parameters governing patent infringement

Generally speaking, patent owners in California are expected to understand the parameters involved with filing an infringement claim on time. SCA Hygiene's lawsuit against First Quality Baby Products over adult diapers underscores the importance of timeliness when attempting to protect a patent from infringement. According to the decision levied by the U.S. Court of Appeals for the Federal Circuit, a viable defense for the accused infringer may be the legal doctrine of laches.

Microsoft lawsuit over patents

Investors in California may be interested in finding that Microsoft has filed an antitrust lawsuit against InterDigital for patent fraud. On Aug. 20, Microsoft filed a lawsuit claiming that InterDigital was in violation of antitrust laws since it failed to honor their agreement and licence the essential mobile phone communications technology fairly. This recent lawsuit is just the latest chapter in a long lasting dispute the two companies have had over patent licensing issues.
